(a) Battery is:
(1) knowingly or intentionally causing bodily harm to another person; or
(2) knowingly inducing physical contact with another person when doing so in a rude, abusive, or angry manner;
(b) A damaged battery is:
(1) (A) Knowingly causing serious bodily harm to another person or disfiguring another person;
(B) knowingly causing bodily harm to another person with a deadly weapon or in a manner likely to result in serious bodily harm, disfigurement or death; or
(C) knowingly causing physical contact with another person in a rude, abusive or angry manner with a deadly weapon or in a manner likely to result in serious bodily harm, disfigurement or death;
(2) (A) recklessly causes serious bodily harm to another person or disfigures another person; or
(B) recklessly inflicting bodily harm on another person with a deadly weapon or in a manner likely to result in serious bodily harm, disfigurement or death; or
(3) (A) Committing a K.S.A. described action. 8-1567 and amendments thereto if such action results in grievous bodily harm or disfigurement of another person; or
(B) Committing a K.S.A. described action. 8-1567 and as amended, if such action results in physical harm to another person in circumstances where such action could result in serious personal injury, disfigurement, or death.
(c) Charges against a police officer are:
(1) Battery, as defined in subsection (a)(2), committed against:
(A) Uniformed or duly identified university or campus police officer while such officer is engaged in the performance of his or her duties; or
(B) a uniformed or duly identified state, county, or city law enforcement officer other than a state correctional officer or employee, correctional officer or city or county officer, juvenile detention center officer or employee, or juvenile detention center officer or employee while that officer is engaged in the performance of his duties; or
(2) Battery, as defined in subsection (a)(1), committed against:
(A) Uniformed or duly identified university or campus police officer while such officer is engaged in the performance of his or her duties; or
(B) a uniformed or duly identified state, county, or city law enforcement officer other than a state correctional officer or employee, correctional officer or city or county officer, juvenile detention center officer or employee, or juvenile detention center officer or employee while that officer is engaged in the performance of his duties; or
(3) Battery, as defined in subsection (a), committed against:
(A) a government officer or employee by a person in the custody of the Secretary of Corrections while such officer or employee is engaged in the performance of that officer or employee's duties;
(B) an officer or employee of a juvenile detention center by a person who is incarcerated in such a juvenile detention center while such officer or employee is engaged in the performance of the duties of such officer or employee;
(C) an officer or employee of a juvenile detention center by a person incarcerated in such juvenile detention center while such officer or employee is engaged in the performance of the duties of such officer or employee; or
(D) a city or county correctional officer or employee by a person incarcerated in a city detention facility or county jail while such officer or employee is engaged in the performance of that officer or employee's duty.
(d) Aggravated assault against a police officer is:
(1) Aggravated bodily harm as defined in subsection (b)(1)(A) committed against:
(A) Uniformed or duly identified state, county or city law enforcement officer while the officer is engaged in the performance of his or her duties; or
(B) uniformed or duly identified university or campus police officer while such officer is engaged in the performance of his or her duties;
(2) aggravated assault as defined in subsection (b)(1)(B) or (b)(1)(C) committed against:
(A) Uniformed or duly identified state, county or city law enforcement officer while the officer is engaged in the performance of his or her duties; or
(B) uniformed or duly identified university or campus police officer while such officer is engaged in the performance of his or her duties; or
(3) using a motor vehicle knowingly causing bodily harm to any:
(A) Uniformed or duly identified state, county or city law enforcement officer while the officer is engaged in the performance of his or her duties; or
(B) uniformed or duly identified university or campus police officer while such officer is engaged in the performance of his or her duties.
(e) Assault against a school employee is assault, as defined in subsection (a), committed against a school employee in or on school property or grounds containing a building or structure owned by a unified school district or a accredited school non-government school is used for the instruction or visitation of students or extra-curricular activities of students enrolled in kindergarten or any of grades 1 through 12, or for regularly occurring school-sponsored activities or events during the time of such staff engaged in the fulfillment of his duties.
(f) Assault against a mental health worker is assault, as defined in subsection (a), committed by a person in the care of the Secretary for Social and Rehabilitation Services against a mental health worker while this employee is engaged in the performance of the duties of this employee.
(g) (1) Battery is a Class B personal offense.
(2) Endangered battery in terms of:
(A) Subsection (b)(1)(A) is a category 4 personal crime;
(B) subsection (b)(1)(B) or (b)(1)(C) is a category 7 personal crime;
(C) Subpart (b)(2)(A) or (b)(3)(A) is a category 5 personal crime; And
(D) Subsection (b)(2)(B) or (b)(3)(B) is a category 8 personal crime.
(3) Charge against a police officer for:
(A) Subsection (c)(1) is a Class A personal misdemeanor;
(B) Subsection (c)(2) is a category 7 personal crime; And
(C) Subsection (c)(3) is a Grade 5 personal crime.
(4) Serious bodily harm against a police officer within the meaning of:
(A) subsection (d)(1) or (d)(3) is a category 3 personal crime; And
(B) Subsection (d)(2) is a Grade 4 personal crime.
(5) Assault against a school employee is a Class A misdemeanor.
(6) Assault against a mental health worker is a Grade 7 personal crime.
(h) As used in this section:
(1) “Prison” means any facility or facility under the authority and control of the Prison Secretary;
(2) “State Correctional Officer or Employee” means any officer or employee of the Kansas Correctional Service, or an independent contractor or employee of such contractor, who works in a correctional facility;
(3) "Official or employee of a juvenile detention center" means any officer or employee of the juvenile justice authority, or an independent contractor or any employee of such a contractor, employed in a juvenile detention center within the meaning of the K.S.A. is working. 2013 supplement. 38-2302 and amendments thereto;
(4) "Official or employee of a juvenile detention center" means any officer or employee of a juvenile detention center within the meaning of the K.S.A. 2013 supplement. 38-2302 and amendments thereto;
(5) “City or county correctional officer or employee” means any correctional officer or city or county employee, or an independent contractor, or any employee of such contractor, who works at a city detention facility or county prison facility;
(6) "School Employee" means any employee of a unified school district or an accredited non-public school for the instruction or care or extracurricular activities of students enrolled in kindergarten or in grades 1 through 12; And
(7) “Mental Health Staffer” means a staff member in the Department of Social and Rehabilitation Services who works at Larned State Hospital, Osawatomie State Hospital and Rainbow Mental Health Facility, Kansas Neurological Institute and Parsons State Hospital and Training Center, and treatment staff as defined in K.S.A. 59-29a02 and amendments thereto.
